AADVANTAGE® GIFT CARD MARKETPLACE TERMS OF USE

a) The AAdvantage® Gift Card site (the “Marketplace”) is owned and offered by American Airlines, Inc. and its affiliates and subsidiaries (“American Airlines”), and is at all times subject to these terms and conditions, and to the terms and conditions of the AAdvantage® program (the “AAdvantage® Terms”) and the terms and conditions with respect to American Airlines’ websites, mobile app and select retail outlets (the “Platform Terms”). These terms and conditions, together with the AAdvantage® Terms and the Platform Terms are collectively referred to herein as the “Terms”.

b) By accessing, using, or facilitating access to the Marketplace or by making redemptions through the Marketplace (including by clicking the “I agree” or similar buttons), you expressly indicate your acknowledgment and acceptance of these Terms. 

c) American Airlines, at its sole discretion, may modify these Terms at any time without notice. Once the amended Terms are posted on the Marketplace, your continued use of the Marketplace thereafter will constitute acceptance of any such amendment.

d) You hereby consent to receive electronic communications, including redemption confirmations, from American Airlines, American Airlines’ service providers and Merchants, whether addressed to the email address associated with your AAdvantage® account or another email address that you provide. You acknowledge and agree that any communication via email or postings on the Marketplace satisfies any legal requirements that such communications be made in writing.

a) On the Marketplace, you have the ability to exchange AAdvantage® miles for gift cards and other goods offered by participating independent merchants (“Merchants”). “Redemption” means a redemption of AAdvantage® miles by you in exchange for any gift card or goods via the Marketplace. 

b) Offers and redemptions for gift cards and other goods on the Marketplace are only available to residents of the United States located in the 50 states, the District of Columbia, the Commonwealth of Puerto Rico and the U.S. Virgin Islands.

c) Offers and redemption amounts for gift cards and other goods on the Marketplace are subject to change without notice and may vary by member (e.g., based on AAdvantage® status). Other restrictions may apply, including a daily limit $1000 on the maximum value of Redemptions that you may make via the Marketplace. All gift cards and other goods are subject to availability. You will be notified if the Redemption you have ordered is not available or if and when it will become available. 

d) You may complete Redemptions for such amount of AAdvantage® miles as indicated for each gift card or other good in the Marketplace, provided that you have sufficient AAdvantage® miles available on your AAdvantage® account at the time of redemption. AAdvantage® miles that are not yet accrued and credited to your AAdvantage® account at the time you place an order are not available to redeem. You may not combine AAdvantage® miles from two or more accounts on a single transaction. AAdvantage® miles may be deducted from your account as soon as a Redemption is completed. In the event that miles have not been properly debited from your account at the time of redemption, such miles may be debited by American Airlines from your AAdvantage® account at any time.

e) The redemption amounts on the Marketplace include all applicable sales taxes and fees.

f)  AAdvantage® miles have no cash or other monetary value. Gift cards obtained via a Redemption may only be used with the Merchant issuing the card and may not be reloaded (although you may complete a Redemption for a new gift card issued by the same Merchant). In no instance will the Marketplace offer or permit the conversion of AAdvantage® miles into a cash amount and the payment of such cash amount to you or another person (or any similar transactions), including, but not limited to, in the case of return of a gift card or the cancellation or termination of your AAdvantage® account. 

g) AAdvantage® miles are not refundable once a Redemption has been made. 

h) To complete a Redemption on the Marketplace, you will be required to authenticate your Advantage® account via text message as part of multi-factor verification, even if you are already logged in. American Airlines will send a verification code via text message to the phone number listed on your AAdvantage® account. You are responsible for any applicable SMS or carrier charges. If you do not have a valid phone number associated with your AAdvantage® account, you will not receive a verification code and will be unable to complete your Redemption. To add or update a phone number, access your AAdvantage® account at AAdvantage® or contact AAdvantage® Customer Service. Neither American Airlines nor its service providers are responsible for any inability to complete a Redemption on the Marketplace.

a) Gift cards and other goods available for Redemption may be subject to separate terms and conditions of the relevant Merchant (“Merchant-Specific Terms”). You agree to abide to such Merchant-Specific Terms. Neither American Airlines nor its service providers are bound by, or subject to, any Merchant-Specific Terms.

b) Merchant-Specific Terms may contain restrictions on your use of a gift card. For example, not all of a Merchant’s product and services may be available for purchase with a gift card. Additionally, gift cards might not be usable at all Merchant locations, and gift cards may be subject to restrictions with regard to online or in-person purchases. Items or services purchased with gift cards may be considered final sale and may not be refunded, as determined by the applicable Merchant. Please review the Merchant-Specific Terms carefully to understand any applicable restrictions on your ability to use a gift card before completing your Redemption.

 
c) Where permitted by applicable law, gift cards may be subject to expiration dates. If applicable, expiration dates will be set forth in the applicable Merchant-Specific Terms. Expired gift cards will not be replaced, and any unused funds on an expired gift card will be forfeited.

d) Unless otherwise set forth in the Merchant-Specific Terms, gift cards available for Redemption are not replaceable, including in the event of loss, theft, damage or unauthorized use. You should treat any gift card like cash, but acknowledge and understand that gift cards cannot be redeemed for cash unless required under applicable law or otherwise permitted by the Merchant-Specific Terms.

e) Neither American Airlines nor its service providers are responsible for any of your errors or omissions in any transaction.

f) American Airlines and its service providers disclaim all responsibility for any consequences of a Merchant’s illegal or improper use of the personal information that you provide to a Merchant.

g) Neither American Airlines nor its service providers are responsible for any gift cards or other goods available for Redemption. You acknowledge and agree that any disputes, claims, or issues regarding gift cards or other goods shall be resolved exclusively between you and the applicable Merchant, and that neither American nor its service providers bear any responsibility or liability for any dissatisfaction, defects, or other issues with Redemptions.

h) To the extent legally required, American Airlines notifies you that some states do not allow limitations on how long an implied warranty lasts, so the limitations in the Terms may not apply to you.

a)  Without limitation to the restrictions set forth in the Platform Terms, you may only access and use the Marketplace solely for conducting personal, non-commercial business with American Airlines. You may only use the Marketplace to make non-commercial, legitimate redemptions and shall not use the Marketplace for any other purposes, including making any speculative, false or fraudulent redemptions. Unless you have otherwise entered into a separate agreement with American Airlines, you may not access or use Marketplace for any other reason.

b)  AAdvantage® miles can be redeemed for gift cards or other goods on the Marketplace only by the AAdvantage® member personally. You may not access or use the Marketplace if you an entity, such as a travel agent, unless specifically authorized by American Airlines.

c)  Without limitation to the Platform Terms or the AAdvantage® Terms, any actual or suspected fraudulent, abusive, or illegal activity is grounds for termination of your access to the Marketplace at American Airlines’ discretion and may be referred to appropriate law enforcement authorities. These remedies are in addition to any other remedies American Airlines may have at law or in equity. Neither American Airlines nor its service providers will be held responsible (i) for the exclusion of certain AAdvantage® members from the Marketplace or (ii) for any unlawful use of the Marketplace by any user (including yourself).

d)  In its discretion, at any time, and for any or no reason, American Airlines may prevent or restrict access to the Marketplace or any part thereof for all or certain users or AAdvantage® members, with or without notice. Access may vary by user (e.g., based on AAdvantage® status). American Airlines reserves the right to modify, suspend, or terminate the Marketplace, or any portion thereof, at any time without notice. American Airlines may also impose limits on certain features or restrict your access to parts or all of the Marketplace without notice or liability.

a) American Airlines may collect, process, and share personal information in connection with the Marketplace in accordance with its Privacy Policy (the “Privacy Policy”). By using the Marketplace or making a Redemption, you acknowledge that you have read the Privacy Policy.

b) American Airlines and its service providers shall not be held liable for any delay or failure in performance resulting from causes beyond their reasonable control, including natural disasters, acts of God, acts of terrorism, cyberattacks, strikes, power failures, and governmental actions.

c) The governing law and dispute resolution provisions in the Platform Terms and the AAdvantage® Terms apply to your use of the Marketplace.

d) If any term or provision of these Terms is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of these Terms or invalidate or render unenforceable such term or provision in any other jurisdiction. These Terms constitute the sole and entire agreement between you and American Airlines with respect to the Marketplace.
